Can overseas Pakistanis sell or transfer property without coming back to Pakistan?
Yes. An overseas Pakistani can execute a General or Special Power of Attorney at the Pakistani Embassy or Consulate in their country of residence. Once attested and sent to Pakistan, we handle the sale, transfer, or registration on your behalf. NADRA's digital POA system also allows online application in certain cases.
What is a succession certificate and do I need one?
A succession certificate is a court-issued document that legally establishes the heirs of a deceased person in Pakistan. It is required to access bank accounts, transfer movable assets, and claim financial instruments. If a family member has passed away leaving assets in Pakistan, you will very likely need one β especially as an overseas Pakistani.
How long does a succession certificate take?
A succession certificate typically takes 2 to 6 months, depending on the court's caseload and whether the matter is contested. With proper documentation and experienced representation, uncontested matters are completed on the lower end of that range.
Can I file a family court case in Pakistan from abroad?
Yes. You can appoint us via a Special Power of Attorney to file and represent you in family court proceedings β including divorce, khula, child custody, and maintenance. Physical presence is generally not required during proceedings, though may occasionally be needed for specific hearings.
How do I give power of attorney from outside Pakistan?
We draft the POA document for you in the correct format. You then sign it before two witnesses at the nearest Pakistani Embassy or Consulate, which attests it. You courier the original to us in Pakistan, where we submit it to MOFA for further attestation and then register it for use in courts or property offices.
